On Tuesday, October 2, 2012, EPCOR Water Arizona Inc. and Chaparral City Water Company (collectively referred to as "EPCOR" or the "Company"), filed a request("Request") with the Arizona Corporation Commission ("ACC" or "Commission") seeking an accounting order that would allow the Company to defer up to twenty-four months of depreciation expense and post-in-service allowance for funds used during construction ("AFUDC") on utility plant placed into service between general rate case proceedings.
EPCOR's request was based on a recommendation contained in an ACC Staff report on a series of water issue workshops (conducted pursuant to Decision No. 71878) which was filed on Monday, March 19, 2012.
On Friday, October 26, 2012, RUCO filed an Application to Intervene in the matter.
On Wednesday, November 7, 2012, the Administrative Law Judge ("ALJ") assigned to the case issued a Procedural Order granting intervenor status to RUCO.
On Friday, January 18, 2013, EPCOR filed a request for procedural order setting a procedural conference to provide for a schedule for the processing of the matter.
On Friday, January 25, 2013, the Administrative Law Judge ("ALJ") assigned to the matter issued a Procedural Order scheduling a procedural conference on February 5, 2013, commencing at 3:00 p.m., or as soon thereafter as is practicable, at the Commission’s offices, 1200 West Washington St., Hearing Room No. 1, Phoenix, Arizona, for the purpose of allowing the parties an opportunity to discuss whether a hearing should be held in this matter, and if so, an appropriate procedural schedule.
On Tuesday, February 5, 2013, the ALJ assigned to hear EPCOR's request conducted the scheduled procedural conference on the matter. The parties to the case will file a recommended procedural schedule on EPCOR's request by Wednesday, February 20, 2013.
On Wednesday February 20, 2013, EPCOR filed the Company's proposed procedural schedule.
On Thursday, February 21, 2013, RUCO filed a response to EPCOR's proposed procedural schedule. ACC Staff also filed a response to the Company-proposed procedural schedule.
On Monday, February, 25, 2013, EPCOR filed a reply to RUCO and ACC Staff's comments.
On Tuesday, March 19, 2013, the ALJ assigned to hear the matter issued a Procedural Order scheduling an evidentiary hearing at 10:00 a.m. on Wednesday, August 28, 2013 at 1200 W. Washington, Hearing Room No. 2, Phoenix, AZ 85007.
On Thursday, March 28, 2013, EPCOR filed a request to vacate the March 19, 2013 Procedural Order due to noticing issues. EPCOR stated in its filing that the Company intends to provide an update to the Application in June of 2013 and, at that time, will assess the appropriate timing of the processing of the Application and will work with Commission Staff and RUCO to propose an appropriate procedural schedule.
On Tuesday, April 16, 2013, the ALJ assigned to the matter issued a Procedural Orderthat vacated the hearing date, filing deadlines, and notice requirements set forth in the Procedural Order issued on March 19, 2013. EPCOR shall file an update by Monday, July 1, 2013 regarding the Company's proposal for processing the accounting order request.
On Friday, June 28, 2013, EPCOR filed a request to close the docket. EPCOR stated in its filing that the Company intended to pursue the matter on a district by district basis in pending and future rate cases.
On Tuesday, July 2, 2013, the ALJ assigned to the matter issued a Procedural Order that granted the company's request for administrative closure.
